There are drivers, most notable Mark Webber, that have Briatore as their manager that don't want to give him up. Personally, as much as Briatore sucks, he's a personal friend of Ecclestone, and that's a good connection I'd like to have if I were a driver picking my manager.
So far FIA has stated they won't renew a SuperLicense to any driver that employs Briatore as their manager, which this lawsuit would overturn. I don't really have a problem with that... but I would have a problem w/ Briatore being in a position where he would be making race-day decisions. They should have upheld that part of his ban.
