As I understand it, the company that supposedly holds the patent only filed the claim 3-4 years ago against Sony and Microsoft. The two companies couldn't claim prior art, because the patent was filed before the first controller with
built in rumble technology came out. Microsoft settled out of court, and bought a stake in the company. Sony kept fighting it, and was eventually forced to pay a shitload of money and they stopped selling the controllers. And, due to that, they took rumble out of the PS3 controller.
A suit still hasn't been filed against Nintendo, but considering the popularity of the Wii, they might see one soon.
